The contents of this webinar may be summarized in the following: An overview of the FCA and how it works, the prohibitions of AKS and Stark II, and their available safe harbors. Then, it will explain what consequences the violation of the AKS and/or Stark II can bring, prominent among which is the FCA concerns it raises. It will then move on to an assessment of enforcement activities, at which the expert will show what kind of risks the participants may be at. It will then move on to a review of recent cases, at which the way in which they potentially impact participants will be explained.
Over the three hours of learning at this session, participants will learn everything relating to the Federal False Claims Act, including its whistleblower provisions to identify and prosecute healthcare fraud. The OIG’s Joint Venture Advisory Opinion, where a hospital expands into a related service line by contracting with an existing provider of that service, will be analyzed in depth, as will Stark II, whose exceptions and how to fit within an exception will be emphasized.
